thoughts

i have analyzed every member of all 3 sides of of my family in search of a family member that has done anything for the greater good or for change, i came up with 3 out of the hundred or so i looked at,the first was my mother because she was a teacher of special needs students and loved her job and basically worked for free in the catholic school system, the second is my cousin brenda because she brings abojut 30,000 books to africa every year and the 3rd is my brother because he turned his back on our father and our whole families addiction issues and chose a good woman for a wife and has 3 kids that he worships. i ache and yearn for some way for myself to help or change the status quo, i really want to make a difference,i want to leave my mark when i'm gone

i asked tims sister and bf to move here and stay with us the bf got a job offer last night as a construction supervisor,told them they could stay with us till they got settled, i also told the painter dude he could live here in exchange, he does 40-50 hours of work on the house a month and we don't charge him rent, they are all at bogies right now eating the mexican thing they do on monday nights

i've read about a dozen books in the last week, i went through 6 books of gay fiction short stories that were written in the early, mid, late 80's and very early 90's,maybe 150 short stories in all,really good for me to reconnect with that era, hiv/aids was just starting to spread and regan was president and ignoring it and so all the activist groups were forming, and i mean really radical gay groups it was a great time for young fags like myself, by ignoring aids regan really restarted the gay liberation movement so for that i thank the idiot, you know everyone i knew from the 80's and 90's are dead now all of them except me,tim and my friend veronica in san fran and she has hiv but not aids, ialso just read the lincon lawyer, and some trash by evanovitch and grafton and then a book on munchousins by proxy and i can't remeber right now the other books, lol i read them and just pick up the next one, oh i finished the book about the presidental marriages and history and the one about washingtons presidency and now i'm on henry the 8ths 3 sisters

one had to wonderwhy the ex senator jones and malcom,one of the current gov right hand men spent so much time together the other day, was it because jones is the front man for golden resorts and malcom represents the gov and we also found out that the woman that owns an upscale "boutique" is a big financial supporter of this administration which we figure is why the taxi vans were shifted from the downtown post office over to gov parking lot when dropping of cruise ship passengers, makes sense she does not want them anywhere near company street with their money,lol ya gotta love sneaky but then this is the same woman that ran a downtown groups finances into the major red and everyone pretty much despises her and her "facelift" employee

well his sister has been a falling down out of control drunk at night since they've been here,i worked 32 hours in 2 days and i came home tonight and went to bed only to be woke up by the 3 drunks coming home and her screaming that someone had been in their room while they were gone because the door was open and because i was the only one home when they got here she started in on me, lol i just told her her she was a fat drunk pig and closed my door on her face and then she started yelling about how the drugs from her room were missing and i took them, lol as if i needed old lady menopause drugs,lol and then i told her that if you did not actually lock that door the dogs always pushed it open to sleep on the bed but nope it's my fault after all those hours at work i came home and stole her menopause drugs, god why can't these people just die and leave me alone, on a brighter note the brother in law is paying a contractor to paint the ceilings in the rooms where the new kitchen and entryway are going,just went over to watch the guys painting,looks really good these 2 are doing a great job,the color is a real pale yellow

went to rowdy joes thursday night, 4 of us, we had dinner,they had a cubano,a turkey pot pie and the asian ribs which they all liked very much,i had the blackened fish tacos and i swear to god it was my best food experience since cafe christine shut down for summer, i had them served with green papaya slaw and i could have eaten them all night long,lol a mouth orgy of flavors. I was the only one that had dessert so i had the key lime ice cream in a cone and once again a mouth orgy of flavor, much better in my book than the mass produced "gourmet" products,i'm going back tomorrow for the same,lol when i get burnt out i'll go over to the other "new" place up here and try them out, the owner started us out and then a young woman named marinly or marion (by that time it was kinda loud and well my hearing is shot from all the concerts i went to) took over and she was a breath of fresh air,lol not "jaded" like the rest of us old timers in this business

Prosser Case Leaves Some Local Businesses on the Spot

Though you did real work or sold real goods, if you are one of the dozens of Virgin Islands businesspeople served papers demanding you return ICC money spent on Jeffrey Prosser's behalf, get an attorney; the law may not be on your side.
ICC, which used to belong to Prosser, is in Chapter 11 bankruptcy. ICC owes its creditors the better part of a billion dollars. Required by law to try to recoup millions of dollars of company money misspent by ICC's former owner Jeffrey Prosser for his own personal use, ICC's court appointed Chapter 11 Trustee Stan Springel filed a slew of lawsuits in July and September. Of $35.8 million being sought for ICC's creditors, $14.4 million is from companies, stores and individuals with V.I. addresses.
In many cases, money is being sought from banks and former employees. But Prosser also spent gigantic sums of ICC money on all kinds of ordinary goods and services, and the trustee is seeking those too.
Those in Springel's sights include contractors paid by ICC for work on Prosser's personal residence at Shoy's Beach on St. Croix. Roofers, painters, masons, cabinet makers, pool contractors, air conditioning contractors, landscapers, plant nurseries, flower shops and drinking water trucking companies are all being hit up to return money given them by ICC for goods and services they provided Prosser.
One of those contractors is Carl Christopher, proprietor of Natural Builders and Quality Developers, whose company did work at Prosser's Shoy's Beach property.
"If they want their money back, they should take it out of the house," Christopher said. "That's where it all is. We had a contractual arrangement for some of the concrete and masonry work, so whatever funds came through us, we can justify what it was for. It went into the building, through materials and wages and taxes we paid. It's not like the money is still around. It is in the building now."
He said it's offensive that the creditors are going after people who just performed work for pay.
"The suit makes us look like we are co-conspirators with Jeffrey Prosser somehow, with a plan to misappropriate funds that were allotted to him, when all we did was honest work for honest pay," he said.
Christopher said the creditors gave Prosser half a billion dollars without knowing what he was doing with the money.
"You'd think there would be some kind of expenditure plan before they handed over the first $100 million, how are you going to invest it, how are you going to pay it back."
Most of the other contractors being dunned would not speak for attribution but said off the record they basically agreed with Christopher's assessment.
Yet, though it may seem unfair, the law may not be on the side of those contractors. Two independent bankruptcy law specialists, both with no prior knowledge of the details of the case, painted a fairly dire picture of the legal situation.
"This is a classic Dickensian example of when the law is an ass," said Jason Kilborn, assistant professor of law at John Marshall Law School in Chicago. "The trustee can say that regardless of their intentions, if the company gave you money and you gave nothing back to the company, and the expense … deepened the insolvency; that is what lawyers call 'constructive fraudulent conveyance.' That's in lawyer speak of course, for it isn't really fraud, but under the law it is. And the only defense that can really be put up is to challenge whether the company was actually insolvent at the time."
New York bankruptcy attorney Myles Alderman Jr. gave much the same bleak assessment.
"Say, if you were hired to do work for the president of a local business, to paint his house. And you're given a check from not him but his company; do you say wait, this isn't the right person?" Alderman said. Legally, to be safe, you should ask for payment from the person or business that is receiving the work. And a business owner has a fiduciary duty not to use company checks to paint his house.
"The reality is of course if you have someone who is going to defraud creditors, they aren't going to care about their fiduciary duty," Alderman said. And many a contractor isn't going to question when the owner of a company gives him a company check for private work.
Unfair as it seems, the trustee is legally bound to go after this sort of money.
"The law imposes on the management of an insolvent company a fiduciary duty to the creditors," Alderman said.
If the trustee chose not to file these claims, ICC's creditors could actually sue the trustee and potentially go around the trustee and sue these contractors themselves, Kilborn said, echoing Alderman.
What should someone do? Get a lawyer, Kilborn and Alderman both said. One can sue Prosser for the money, they said, though that may not be very effective at this point. Those who performed work on Prosser's property may be able to attach mechanics liens against the property for their costs, they said, recovering their money when the property is sold.
"The most likely resolution is the trustee will be realistic and settle on many of the smaller cases," Kilborn said. "He has to sue, but may not have to drive for every penny. So if a shop owner is able to offer something that isn't laughable, there will be a settlement."
If it is likely to cost more to sue than the trustee is likely to ever be able to recover, he may allow some to be dismissed too, Kilborn said.
Bankruptcy judges have some leeway to decide what is equitable too, and there are many defenses against this type of claim, so it is very much in the interest of those being sued to get a lawyer and dispute the claims, Alderman said.
"What good judges do is basically act as circuit breaker," he said. "Equity courts give judges a fair amount of latitude."
But get a lawyer.

men who don't pay child support

ok here on stx we have 3 resort projects that have made it through czm and are onto the next steps,if only the tree huggers and do gooders would leave them alone stx might actually be making some forward progress,diegeo will make captain morgan rum here for the next 60 years here starting in 2012,cruzan and ronrico rums will also be made here for 30 years,we have a home depot breaking ground on the 2nd of november and an ihop opening soon at sunny isle, things are looking up for the "red headed step" child of the usvi and it's about time. Alot of the problems here on stx stem from the fact that alot of stx politicians here are the "whats in it for me type of people" corruption is the main game here, recently is was published in the paper that the usvi generates 19 billion in yearly revenue and 16 billion of that comes from stx and we receive the least amount of service our 2 sister islands get everything because that is where the capitol is located, we've tried to breakaway in the past but it won't happen anytime soon, we want self rule here,we may be one territory here but we are 3 very distinct and separate cultures and islands, stj is like newport RI stt is like manhattan and stx is like the midwest, we have alot of really fucked up politicians here that want "native" only rule but they know longer have the majority,lol i'm tired of this rant so i'll stop now, more later

nice and breezy today,a week ago sunday i planted about 50 papayas and 20 pineapples,they seem to have adapted to being in the ground,now i need to fertilize them, we have a well so water is not a problem,i just read a book called called "brooklyn" takes place in the 50's in brooklyn and Ireland,a coming of age story about a young irish girl, really good book, now i'm reading "await your reply" a really really good book about identy theft by dan chaon

general answers to the why why why questions

i get asked alot of questions about why i moved here, we first came here in april of 1994 to visit a couple that had moved here from minneapolis,i loved it the minute i stepped off the plane and knew that i was finally "home",it took me about 6 years to convince the tim that he wanted to live here as well. When we stepped off the plane the first thing that hit us was the humidity and the smell of the ocean,it was great after the coldness and sterility of minnesota,it was so green and overgrown here,flowering trees ,shrubs and palm trees, the dumpy little airport was great,they push the stairs up to the plane and you exit onto the tarmac, our host met us and took us to his b and b in the hills above fredriksted,back then it was clothing optional and that was why we chose to stay there instead of with our friends from minnesota(not too many clothing optional places in minnesota you know). We ended up staying for 10 days,just exploring the entire island and in the end we decided it was the weather that appealed to us the most,not the beach, the ocean,the people or the culture it was the weather,it really is perfect here weather wise,no blizzards,tornadoes,just an average temp of 85 year round,if you're going to get hit by a hurricane you know at least 3 days in advance and we've only had 3 good ones in 15 years. today i start writing about my life down here on st.croix,i've been here on and off for 14 years,bought a house here in 2000 and moved here full time in 2001.I'm a waiter/bartender in my 40's,live with my ex outof financial necessity,have 3 dogs and 3 cats. Our house is in the country about 3 blocks from the beach and about 25 minutes to either of the 2 towns here or the center island shopping mall,more later.
